Porta Potty Permits in Montgomery County and Nearby
When a porta potty needs a permit, which office handles it, and how to avoid one entirely. Covers county roads, Gaithersburg block parties, public events and HOAs.

Do I need a permit for a porta potty in Montgomery County?
A porta potty on your own driveway, lawn or private lot usually needs no permit in Montgomery County. A permit applies when the unit sits in a public street or sidewalk, or when it serves a public special event. HOA rules may still apply in planned communities.
This guide is general information, not legal advice. Confirm with the office listed for your town before your delivery date.
Units placed in a county road
A porta potty placed in a Montgomery County public right-of-way needs a right-of-way permit from the Department of Permitting Services. The county issues similar permits for dumpsters and storage containers for up to 6 months with no extensions. Cones or a traffic plan may be required on busy roads.
See the DPS right-of-way container guidance. Incorporated cities, including Gaithersburg, Rockville and Takoma Park, manage their own streets, so call the city instead. The simplest choice is to keep the unit on the driveway.
Block parties in Gaithersburg
The City of Gaithersburg block party permit covers gatherings under 200 people on a local residential street that end before 9 pm. The fee is $50 if filed 4 or more weeks ahead and $75 after that. The city accepts no applications 2 weeks or less before the event.
The site plan asks where the porta johns go, and the city event tool kit asks for the portable toilet company's contact details. See the city block party application and our block party checklist.
Public special events in Montgomery County
Public events in unincorporated Montgomery County need a Permitting Services special event permit filed at least 30 days ahead. Tents over 200 square feet need a use and occupancy certificate, and generators of 6 kVA or more need an electrical permit. Montgomery Parks events need a separate Parks permit.
See the DPS special event permit page. A restroom trailer on a large generator can trigger the electrical permit, so ask about trailer power when you plan.
Rules in nearby counties
Nearby counties set their own event rules. Frederick County requires a sanitation service contract for outdoor events with portable toilets. Prince George's County asks for event permits about 45 days ahead. Fairfax County requires a health permit for events with temporary outdoor toilets. DC requires a DDOT public space permit for anything in the street.

HOA and community association rules
Montgomery County has hundreds of registered community associations, and many limit temporary structures that can be seen from the street. Planned communities such as Kentlands, Lakelands, King Farm, Fallsgrove, Clarksburg Town Center and Montgomery Village often ask for notice. Ask your HOA before delivery.
Placement behind the house or beside the garage, with the door facing away from the street, usually solves the issue. See the placement guide.
